It always amazes me when the legal eagles acting for the accused whine and bitch to the media, who take up the cause, that there’s no proof and that proof should be shown that their precious client hasn’t done anything wrong…When showing that proof may impact ongoing investigations, and endanger investigators.I don’t like Haneef. I don’t think that he should be allowed to come back to Australia, especially after badmouthing the government and it’s departments. He’s not an Australian citizen and he is just here making money for his family at home.

It’s obvious to anyone with the intellect to realise it. Hicks is one of our own, just like most parents can’t stay angry at their kids for long, and will delude themselves that any bad behaviour is just good natured hijinks, we can’t be too pissed off at one of our own. Those foreign terrorists though, different story. Up against the wall at dawn, and if they happen to be brown like me, well makes it so much easier to get a good rage up. (VTIC). Doesn’t matter if they are alleged terrorists or not, we can’t get huggy with foreigners, next thing you know they will be having parades on public holidays, bringing foreign food with mysterious spices and before you know it, your favourite daughter is marrying one of them. One of our own on the other hand is a different story, they can marry somoene elses daughter.

I think that anyone I know who may be classified in that count would probably be thinking of the fight in Israel and “Palestine” and “they are all as bad as each other”. I must admit I thought that way a long time ago. Not anti or pro, just all as bad as eachother.
I can see the injustice now, I think I may have thought that because of the poisonous lies fed to all by the MSM.Now I feel bad at having admitted that. But I think I can blame the MSM for the information I received. Very one-sided. Fortunately my eyes are open now, and have been for a long time. Figuring out that the MSM was pedaling lies helped.

I know it’s O/T, but harking bark to the Canadian beer fridge drama of a couple of threads ago, it looks like Wimpy and Andy are going to have to buy an extra beer fridge.
Flanagan starts by making a few genuflections in Howard’s direction to ward off charges of partisanship. A slim effort, and ultimately negated by what follows. Then he comes up with this (and from here on his writing goes from bad to worse):

Hicks is plaything of the Left, an opportunity to get back at Howard. It does show up their shallow values. Same with their demonisation of Ayaan Hirsi Ali. It seems religion trumps human rights for many of them. I did type a few more sentences, but deleted them, to be replaced by this word, hypocrisy. So Dawood wants to be anonymous. I would say he would. The deal he must have cut, may have peeved a few of his former colleagues off, the way he spilled his guts and renounced membership of his Islamofacist club. I believe they have long memories and that they don’t hand out slaps on the wrist and a stern talking to, when it comes to malcontents. Then again, I won’t shed a tear for him. Maybe the MSM, in a rush to make him a ‘personality/victim’ will provide a 24/7 minder service, perhaps their ABC would be in the running.
Hi kae … I’ve got seven weeks accumulated leave to be taken in a weeks time. I’ll be spending more time down at the beach with the kids, and unwinding from another stressful year. Next year might see China or Melbourne, don’t know which one to pick. China sounds nice, but I can’t speak Mandarin like Kev can. I only know a few words.

I wonder how all the people berating Hicks would feel if they had a relative locked up for five years without charges being laid.
What many of you on here don’t seem to realise is that many people think Hicks WAS an idiot and possibly a criminal for doing what he did.
What many people like myself do not agree with was the way he was treated and the length of his internment without charge and without following standard legal protocol (such as those pertaining to me evidence and testimony).
It is lazy journalism when Blair picks up some crazy left field source saying Hicks is a hero and then assuming all defenders of Hicks hold that position.
In debating that is call the “straw-man theory”. Oversimplifying your opponents argument and then demolishing that oversimplified argument. I call it weak and lazy journalism.

I’m not sure exactly how many times I have to point this out to the less intellectually gifted amongst us. The David Hicks case was an early example of a situation that is likely to become more common as the enemies of democracy realise that their power lies not in the barrel of a gun, but in their ability to manipulate the opinion of the voting mass in the major democracies.
Hicks is a nobody, both in impact on the physical battlefield and in the real legal sense. He is a physical nobody because he is an inherent coward who talked a big game and then soiled himself when it became real. In a legal sense, he is neither a combatant nor a non-combatant. There are rules for combatants, laid down quite succinctly in the Geneva Convention. They include uniforms, chains of command etc. By his own admission, he is also not a non-combatant. What to do with him? The shallow thinkers of our time would have him tried as a common criminal. Does this fit the crime inherent in his intent, if not the cowardly nature of his actions? Not by a long shot. Is he a Prisoner of War according to the Geneva Convention? Not by a long shot. The duration of his incarceration at Gitmo stemmed from two basic sources. Firstly, there was no legal precedent for a wanker like him taking up arms against his sovereign government and their allies but not as a part of a recognized and legitimate foe. Secondly, his own legal team, obstinate in their own stupidity and overwhelmed by their sudden celebrity, stalled and delayed the process hoping to gain political mileage. All the while, poor Dawood was getting fat on the purse of the American public at a facility with an evil reputation that doesn’t stand up to any real objective scrutiny.
He was let off for purely political purposes. The illogical and ideologically driven left had gained sufficient traction on the ill informed Australian public to force the government’s hand. We will soon have an avowed Jihadist walking freely among the citizenry of Adelaide

It’s been my experience that in similar situations where a family member goes to bat for a son or brother like Daddy Hicks has, once the focus of all their efforts is released, there is a serious falling out and even a violent confrontation. Don’t be shocked if Pops ends up calling the cops on the idiot.
We would have been better off if the teacher got her 40 lashes, and was then deported. When she landed back in the UK, the press could have photographed her back and then the west would see the kind of morons that we’re dealing with.
We should have allowed her to take one for the team. It would have been a better outcome in the long run.

A combatant who falls into the power of an adverse Party while failing to meet the requirements set forth in the second sentence of paragraph 3 shall forfeit his right to be a prisoner of war, but he shall, nevertheless, be given protections equivalent in all respects to those accorded to prisoners of war by the Third Convention and by this Protocol. This protection includes protections equivalent to those accorded to prisoners of war by the Third Convention in the case where such a person is tried and punished for any offences he has committed.”
Thats being extremely charitable and allowing him combatant status with a recognised entity.
However I dont see Hicks falling into this category that makes him a “privileged combatant”.
“1. The armed forces of a Party to a conflict consist of all organized armed forces, groups and units which are under a command responsible to that Party for the conduct or its subordinates, even if that Party is represented by a government or an authority not recognized by an adverse Party. Such armed forces shall be subject to an internal disciplinary system which, inter alia, shall enforce compliance with the rules of international law applicable in armed conflict.”
The taliban and Bin Ladens mob have NEVER followed the rules of the geneva convention. They offer no quater to captives, regularly attack and murder civillians, and actvely shield themselves with civillians as a tactic.
They have no standing with thin the conventions if the black letter law was to be followed.

#121 – Not to mention that not just the responsibilities, but also the benefits of the Geneva Conventions apply only to signatories. Of course, the big, bad, evil hegemon of AmeriKKKa has always treated prisoners of non-signatories humanely, despite never having that reciprocated. What many people like myself do not agree with was the way he was treated and the length of his internment without charge and without following standard legal protocol (such as those pertaining to me evidence and testimony).
You want to be treated well? Keep your nose clean. Don’t be an idiot who signs up with terrorists.
The criminal justice system works up to a point. Beyond that point you just have to be extra tough on those who are beyond reform. What do you do with guys like these, who were all convicted fair and square, beyond blind-justice agile’s tortured reproach about evidence and testimony.
There is not really any doubt about what Dawood did. Agile is just bitching (as usual) about process. As to good journalism … well, he’s on thin to no ice there too. From what we have seen of the intellectual and writing skills so far, his is a case of arrested development.

He also WENT BACK to Afghanistan after the US-led invasion. There are serious questions about his “innocence”.
Was leaving him without charge for 5 years excessive? Maybe, considering that the War on Terror will probably not conclude for a generation. But lets separate that debate from the one which paints him as a lost soul looking for fun.
BTW Hope KRudd will bring on that judicial investigation of Haneef. There are number of questions that need to be answered – about the role of the Minister in cancelling his visa as well as the exact nature and extent of the links between Dr H and his cousins.
Maybe I will wait for that with baited breath. Oh hold on…probably shouldn’t do that as he is already dropping behind on promises to ratify Kyoto before the Bali meeting.

The legal status of Mo Dawood has been argued, explained and justified over and over here on Tim’s blog. (do some research, ‘agile’, you dickhead)The Geneva Conventions are relatively simple documents, they provide protection for combatants and lay down some simple humanitarian “rules of war”.Mo Dawood is not, and never was a criminal, he is not, and never was, subject to a criminal court in any jurisdiction in the world. He is an “unlawful combatant” engaged in a war, out of uniform, belonging to no recognised force, armed and opposing a legitimate military force, and It would have been entirely legal under the Conventions, to have shot him dead on the spot.
That he wasn’t shot dead on the battlefield as he should have been and never heard of again is exceptionally lucky for Hicks, and I find it seriously appalling that he has become a cause celebre to many disconnected Australians. He is/was our enemy!
If your son/daughter/wife/husband had been wearing an Australian military uniform in Afghanistan where Mo was based, he would have shot them dead as quick as he could have got a shot in.
He definitely needs to be greeted as a hero when he is released from prison, having been ground under the heel of imperialist oppression for years, he will need some good mates to support him.
I recommend the SAS barracks at Swanbourne, WA, or the RAR barracks at Holsworthy, NSW, as a venue for his release party.
