To paraphrase Mark Latham, I reckon Hicks will be home and out of jail/gaol by Christmas.  I suspect he’ll get a little bit more than the 5 years served (i.e. a small sentence once the 5 years are taken into account) followed by a prisoner transfer to Australia, after which the US wont care if there’s a low-key controlled-release or whatever.

      I wonder what Mamdouh Habib did, relative to David Hicks?  At this stage it doesnt seem Hicks actually did that much.

    1. He will not get anything like what Lindh managed to bargain for. Afterall Hicks is not an American and therefore was lucky enough to go to Guantanamo Bay rather than cop the full force of the law the US reserves for its own citizens.

      My guess is he will get three to five at most, will be in Adelaide by June and out by Christmas.

My ideal scenario is : the tribunal chairman takes on board the prosecution’s recommendation of a sentence of 10 less the 5 served, and then ignores it completely on the grounds that they have to send out the strongest possible message to other would-be traitors that this is a game you play for keeps, then proceeds to give him 20 with no reduction for the time spent as a POW.

      If Hicks is relocated to Australia in coming weeks or months, he will probably be transferred to Yatala’s G-division, the highest security facility in South Australia.

      John Justin Bunting and Robert Joe Wagner – the men behind the gruesome Snowtown serial murders – are both jailed at Yatala. One of the state’s most deranged criminals, Bevan Spencer von Einem, also shares a cell at Yatala.

      He is the ringleader of the notorious group of paedophiles and murderers dubbed the “Family”. The group was behind the sex killings of five young men in Adelaide between 1979 and 1983.

      While other inmates may be famous for their heinous crimes, none is more colourful than killer Michael Barry Fyfe, nicknamed the Birdman of Yatala because he was once allowed to keep a rainbow lorikeet in his cell as a pet.

      Perhaps ominously for Hicks, Fyfe has a habit of turning on fellow inmates. He was serving a 25-year sentence for attempted murder and assault in 1995 when he stabbed Trevor Tilley, a former policeman turned rapist, to death in the prison kitchen.
      He has since assaulted and attempted to kill other inmates, admitting to Yatala prison authorities that he finds it difficult to control his temper.

    1. I’m going to be optimistic and guess that he’ll get the max, minus 5. Lets not forget that the judges, not the prosecution have the final say on the sentence. They might be inclined to punish Hicks as much as possible after hearing him testify about the exact nature of his guilt.

      I am not sure of the timing but if Australia was officially allied with the US in regards to the Afghanistan battle, then it could well be that he fits the legal definition of having taken up arms against his own country during a time of war. That is the most strict definition of treason in most western codes, iirc.

      And, it does not matter if the Talib was an “official military” when the issue of treason or other such criminal issues are being discussed.
      The only thing the Talib murderer gangs not being official uniformed national military has any real bearing on is whether or not members of such an outfit would qualify as protected persons or qualify for POW status under the GC.
      Since the Talib was simply a loose knit gang of murdering thugs and not an actual national uniformed military, no member of the Talib qualifies for any protections once caught.

    1. I would like to think minimum of 20 years. It is not just what he has doneor not done, it is what he intended to do had he not been caught.
      It was his intent to return here and contract others to his evil ideology. What would we have to say if he was freed early and then brought down an apartment building or tunnel?
      David- Dawood can NEVER be assimilated back into our society and will have no concerns about killing others if it means he can go down or up in firestorm of martyrdom.
      He will want to avenge us more for his imprisonment. Who will employ him?trust him or feel comfortable in his presence. He is a pariah and should get life.

    1. The whole reason he was never returned here to face charges was that there were no charges to face, unlike the British detainees. The laws now in place to deal with Hicks are, of coure, not retrospective (thanks to the Greens and the Democrats – the ones who have screamed louded over his detention in Gitmo while being responsible for screwing up the legislation to get him here for trial). For the Government to charge him with anything will look like persecution. However, without taking a guess at the sentence I’m sure that the extradition parameters will be sufficient to keep Hicks locked up for whatever remains of his sentence no matter who’s in government. No Christmas pudding on the outside for Dawood – not that the fat bastard needs it.

      As for Shannon, she shouldn’t blame her high school for her weight gain. She should have watched her diet and exercised regularly.
