On January 11, CBS News examined – in their own way – the case of Australian Taliban member and Gitmo homeboy David Hicks:
Today marks five years without a day in court for David Hicks …
And why might that be? ABC national security correspondent Leigh Sales:
The Hicks defence strategy relies on delaying the process for so long that the Australian Government will be forced to ask for the prisoner’s return.
Hmm. Anyway, despite his lawyers’ delaying tactics, Hicks is shortly due to appear in a Gitmo court. Latest word is he’ll make a deal.
UPDATE. Hicks pleads guilty.
UPDATE II. The Australian reports: “Hicks is short and overweight … He did not look unhealthy and certainly not ‘gaunt’ or ‘hollowed cheeked’ as his legal team have described him in recent months.”
UPDATE III. Alan Grey beats me to the punch!
- It’s good to hear that the ABC is in favour of drumhead courts-martial and quick executions as per the Geneva Conventions. I knew they’d get onside one day.Posted by andycanuck on 2007 03 26 at 12:39 PM • permalink
- “Today marks five years without a day in court for David Hicks …”
Tough. We can hold his sorry ass forever (as long as the war lasts), and we could do it even if he was a non-combatant protected by the 4th Geneva Convention…so quit your bitching.

- Is Phil Hirshkorn still writing for CBS News? Because it would be instructive to know that an America-hating, Islamist/terrorist-loving, communist bastard is still working for them. I never read such obscene drivel in my life.
In the past five years, more than 750 men, ranging in age from 10 to 80, have been rounded up in Afghanistan and sent to Guantanamo, where critics say, they have endured mistreatment tantamount to torture
This article makes it sound like 10 year olds and 80 year olds were subjected to torture, instead of being sent home after an initial period of questioning (which they were). David Hicks is presented as a poor, misunderstood boy who was scooped up in some over-zealous witch hunt, and has since been imprisoned in a lightless, coffin-sized dungeon underground.
I hope he gets his trial. Then, finally, maybe some of this crap can get laid to rest, in the leftist dungheap it deserves.
- This is the reason* that he’s shackled to the floor. No more, no less. What a bunch of retards reporters are.
* jump down to the section entitled “Jailhouse stabbing”
- And don’t forget, Rebecca, that about two-dozen releasees have been caught again in arms against Allied forces. (While several others have been quoted saying how well they were treated.)Posted by andycanuck on 2007 03 26 at 04:56 PM • permalink

Today marks five years without a day in court for David Hicks …
And five years without too many days in which his defence team didn’t appear in court seeking further adjournments…
I have no doubt that any guilty verdict will be completely unacceptable to much of the Left who will be convinced it was all rigged.
- Delaying tactics? It’s what we’ve been aware of all along but what the media and Mohammed Daoud supporters in Australia have refused to acknowledge and instead have used as a club with which to beat the Federal Government and non-sympathisers.
Interesting that he’s now apparently going to “plea bargain”. Is this just another way of making sure we never really learn what he was up to?

If a plea bargain is struck and time served is taken into account Hicks could be back in Australia in no time. The argument from Hick’s team – including the ABC and Fairfax cheerleaders – would be that the guilty plea was merely a tactic to get him out of Gitmo, and his innocence would be strongly asserted from the safety of our shores (an action which would surely be contempt of court in ordinary circumstances).
Any plea bargain which doesn’t include a full and detailed confession from Hicks is unacceptable. Instead let the trial run its course and the prosecution lead all of its evidence so the world can see exactly what little Davey has been up to.
- #4 Any deal that doesn’t involve a long drop and a shorter rope ought to be disregarded.
There, Mark, that’s what you meant.

- Actually, I dont want him to ‘cut a deal’ only to return to Australia to be the darling of the left, ‘never convicted, I struck a deal to be closer to my dad, I’m innocent’, blah blah.
There are a few supporters who dont want a trial to take place. Why? Nothing like the truth and a few pertinent details to get in the way of a PR snow job.
- #8 and 9, What further proof is needed that the evil USA will go to any lengths to humiliate their captors. Feed them well, when they are not free to starve? The Horror. The Horror.Posted by Wimpy Canadian on 2007 03 26 at 07:44 PM • permalink
- Nothing like a fair impartial military tribunal to really affirm the US’s commitment to the rule of law. Why on the first day of hearings the judges only removed 2 of his 3 lawyers. I can’t believe they let him keep one. What is the world coming to.
By the way Timmy, its interesting youhaven’t made even one comment about the weekend’s election result in NSW. Whats that make it? 21 State and Territory elections in a row that the Libs and Nats have managed to lose. And how good is Howard going in federal polls?
- Mayhem as Hicks lawyers are disqualified because they didn’t fill in the paperwork. But I’m willing to cut some slack to Hicks:
He was unrecognisable from old photographs of him, although the extra weight has made him resemble his father.
I think now we can say he’s been punished enough.
- #22, mojoo:
We are committed to the rule of law and follow the law as applicable in this case.
What we don’t do, and what causes brain dead morons on the “destroy it all equally” (L)left is that we don’t follow whatever version of fantasy revisionism you want to create for yourselves on a day to day basis.
Hicks appeared in court wearing an olive green outfit, and thongs on his feet.
Hicks’s hair was long, reaching down to his shoulder blades, but he had shaved off a long beard for his first court appearance in two and half years. Is this America’s next top model? Who wrote this? Heidi Klum?
He looked in reasonable health, although, as his father Terry said, he looked puffy.
Puffy from crying? Over eating? The left must be knashing their teeth over this one.
He was unrecognisable from old photographs of him, although the extra weight has made him resemble his father.
Given that most of the photos used by the media of Hicks are him as a young man and/or child, is this at all surprising?
He spoke in a grunting, loud voice, protesting about the loss of his lawyers.

This from the Age:
he saw other detainees — most of whom did not speak English — during randomly timed shower and recreation periods, sometimes late at night or early in the morning.
Lol, how many English speakers were in the camp in Afghanistan?
Mr McLeod said Hicks, who turns 32 in August, looked closer to 40, with receding hair, hollow eyes, dishevelled appearance and suffering serious depression.
Contrast this with the SMH’s report, above.
- (The Praetor’s Sword approaches the Klingon Bird of Prey)
wronwright: MarkL, slow down to impulse speed.
MarkL: Aye commander.
ww: Status, tactical officer.
(silence)
ww: I said status.
(Silence. All minions look at each other in utter confusion)
Grimmy: Uh, sir, which one of us is the tactical officer?
ww: (sighs) You, you nincompoop.
Grimmy: Oh yeah, right. Um, well, this lighted board says that Bird thingy is directly ahead.
ww: Good, good.
(wronwright steeples his fingers in a fashion patterned after his idol, Lord Karl)
ww: Those Klingon girls are about to receive the wrath of wronwright. Science officer, status of the Koloth?
(Grimmy looks at MarkL, silently mouths the words “is that me?”. MarkL shrugs his shoulders)
Grimmy: Well sir, um. Of the what?
ww: (sighs) The Koloth. The Ko-loth. That’s the name of the Klingon Bird of Prey we’re about to vaporize. And just why are you asking me? I directed this question to the Science Officer.
(Again all the minions and scalaways look quizzically at each other)
ww: That’s you Under the Whip.
UTW: Oh, yes. Right-o. Um, well, let’s see what the old read out display tells us. Actually, quite a bit. I’ve been studying it for hours now. Damn, I love this display board. I wish I had this. I would study it for days.
ww: Under the Whip. The status, please.
UTW: For instance, did you know that a supernova is about to explode approximately 4 parsecs away?
ww: Under the Whip.
UTW: Just four parsecs. Do you know what this means? This is an unbelievable opportunity to observe this phenonemon.
ww: Under the —
UTW: In fact, it’s a once in a lifetime chance. We should consider ourselves fortunate, so unbelievably fortunate to be —
ww: UNDER THE WHIP. SHUT. THE. FUCK. UP.
UTW:
ww: I don’t care about the supernova. I don’t care about the scientific knowledge that could be acquired from observing the fucking supernova. I only care that we inflict damage, tremendous damage, and pain, to the occupants of that Bird of Prey.
(silence)
ww: Science officer, once again. What is the status of that Klingon Bird of Prey.
UTW: I thought Grimmy did that.
ww: What?
UTW: Tactical officer Grimmy, or Tac Officer, for short, told us the status of the Koloth.
ww: No. The tactical officer told me the Koloth was directly ahead.
(quizzical looks)
ww: The Klingon ship!
everyone: Oh yeah, right, yeah.
ww: Now. I want the status of that ship.
UTW: Well, isn’t the position of the Koloth part of the status?
ww: Whip, I’m trying —
UTW: I mean status means all facts about a thing. Right?
(various minions murmur their agreement)
UTW: Yes, I mean, if you were to ask me about the status of the supernova, I would tell you everything about it.
SwinishCapitalist: That does sound right.
andycanuck: I think he has a point.
UTW: For instance, this star is approximately 100 times the size of our star. It’s maybe 4.2, maybe 4.3 billion years old. If you want I can get the age more exact. It’s nuclear fuel has been spent and it’s entering the last stage of the supernova procession.
RebeccaH: Wow Under the Whip, you sure know your science.
(all minions and scalawags nod in appreciation)
UTW: I mean, sure I can give you the status. You can certainly say ‘Science Officer, tell me the status of anything’. And yes, I can give you that status. But I mean, I’m just asking, is it right to ask me the status when you just asked Grimmy the status?
ww: Under the Whip. You’re new. So I will be patient. Do you see this? This is called an Excrutiator. Ex-crutia-tor. When I ask what the status of something is, anything, you will tell me the status. Fully. Even if I asked the same thing from someone else just 10 seconds before. You will not mention a supernova. Ever. If you do that, you live. If you don’t, I will apply the Excrutiator, on a very very delicate part of your body. You do not want that. M’kay?
(Under the Whip gulps and nods zealously.)

- Guilty? Guilty? I’m betting he doesn’t feel guilt at all for waging jihad.
That maggot saw the images of innocent people leaping to their deaths rather than burn to death just as we all saw them.
What did that spur him to do? By his own admission he went and fought for the slime that made the attacks happen.
Guilty. Yeah.
- Dawood pleads “guilty” eh?
I can just hear the Usual Suspects bleating and moaning how Mo Dawood was coerced, beaten tortured, denied fresh air, forced to listen to rap “music”, made to eat pork, denied lawyers, tried by kangaroo court, and only entered a guilty plea to be near his dear ol’ Dad, and his pore little kiddies.
They would never be satisfied with any result other than the Pope conferring Sainthood on Dawood, $20 million in the bank, and a nice house on the Gold Coast.
It will be interesting to see the extent of the Australian government’s commitment to WoT in how they handle the administration of Dawood’s sentence. I predict he will be walikng the streets in Australia in six months or less, no control orders, holding a legal passport, free to go back to his terrorist mates, and pockets stuffed with media cash.

- Out of interest I wonder what the deranged posters on this blog think of the following situation:
With the recent capture of British sailors by Iran, we now face the very real prospect of seeing the US’s torture techniques with the tables turned. Say these sailors are subjected to exactly the same treatment the US has been using. Would any of you be perfectly okay with that?
They are being ”interrogated,” apparently. The news reports put that word in quotation marks. I wonder if it emerges that they are being subject to George W. Bush’s preferred euphemism “coercive interrogations.” And if that turns out to be the case, and I pray it isn’t, then what will the United States and its ally Great Britain say in complaint? After all, Iran is only doing to Western soldiers in captivity what the U.S. has been doing to “enemy combatants” since the war began. Then there’s a question of what kind of trial they might face. One in which their defense gets a chance to see all the evidence against them? Oh, wait … the US doesn’t do that either.
The first strategic crisis created by the Bush-Cheney torture regime is now occurring. It won’t be the last. And if these British sailors are found to have been mistreated and their “trials” tainted, who in the international community is now going to come to Britain’s and America’s defense?
This is why it is so imperative that western powers act with honor, and lead by example. Because Iran can now rightfully torture these sailors, hold them indefinitely in prison without access to legal counsel or trial, then try them for crimes against the Iranian state without showing them the evidence against them.
And, thanks to Bush and his supporters such as those who post here, there isn’t a goddamned thing you can say or do about it. Why? BECAUSE YOU DO EXACTLY THE SAME THING.
There you have it, folks. The US and its allies are now officially no better than Iran. How proud you all must feel.

- #70- This illustrates the pig-ignorance of the average leftard in the matter of international law (and most other things except siphoning other people’s dosh for that matter).
The squids grabbed by the Iranians were uniformed soldiers with rank insignia, a rank structure and personal identification; as there is no current state of war between Iran and the UK, it is a matter of kidnap, not capture of combatants, and could be used as grounds for military action against Iran (as happened in the scuffle between Israel and Hezbollah/Lebanon). Iran is on vry dangerous ground, as its actions can only be seen as an agression, and an act of war.
Hicks on the other hand was an illegal belligerant and is lucky indeed to be still wasting oxygen, as he could legally been executed on the spot. - THE PRESIDENT VERSUS DAVID HICKS :
This beautifully shot film embarks on a real journey with David Hicks father, Terry Hicks, as he searches for the truth about his son. After trying in vain to win the support of the Australian government in his battle to persuade the U.S.A. to grant his son a fair trial, Terry decides to launch a one-man crusade to get justice for his son. He follows David’s footsteps through Pakistan and the deserts of Afghanistan, in an attempt to understand what led his son into the situation where he was captured by the Northern Alliance and handed over to the American military.
David Hicks’ letters written to his father from Pakistan, Afghanistan and Guantanamo Bay provide real drama and poignant insight into what motivated this young Australian cowboy to become a freedom fighter for Islam.
Is that what he pled guilty to? Getting handed over to the Americans and freedom fighting?

#8 and 9, What further proof is needed that the evil USA will go to any lengths to humiliate their captors.
Well, prior to, oh, say, LBJ, we humiliated our captors by blowing their countries to bugger all.
Our captives we humiliate the old-fashioned way…

- “Hicks is short and overweight … He did not look unhealthy and certainly not ‘gaunt’ or ‘hollowed cheeked’ as his legal team have described him in recent months.”
Goodness me!
Surely he could have taken a leaf out of the book of another famous australian and attended the trial in a Wheelchair!
That would have pleased SBS no end.
Obviously his defence “team” are not as astute as Skase’s.

- Habib (post #81),
you really are a fucking idiot aren’t you. The British sailors were in Iran’s territorial waters. The sworn statements and maybe even video that Iran will produce after “interrogating” them will provide the evidence of that fact.
As such it is them who have committed the act of war.
What you say? You can’t put any value on sworn statements produced under coercion.Perhaps we might even see a show trial with the detained sailors pleading guilty to entering Iran’s maritime boundary in return for being able to serve their reduced sentences in British prisons rather than Iran’s. Damn that sounds familiar.
- How dare those filthy, devious Americans not mistreat him.
It’s just like those mendacious Yanks to treat him well.
Trying to deny us our hero. Trying to act, like, you know, they’re humane and stuff. No matter. We know the truth. Our innocent young David only pleaded guilty so he wouldn’t have to endure any more electrodes attached to his gonads!
We know the TRUTH!-Phillip Adams
- #122 – Thanks for your contribution, beclowner. It’s been as important as the tittle on the letter i in the word shit.
Now run along. The bell for little lunch rang minutes ago.

- Poor magoo had been stewing on that response for an hour and a half.
As usual, I’d say Habib scored a bullseye.

- Iran is going to torture video cameras into producing visual evidence that the British were in Iranian waters? Holy shit!Posted by Crispytoast on 2007 03 27 at 12:54 AM • permalink
With the recent capture of British sailors by Iran, we now face the very real prospect of seeing the US’s torture techniques with the tables turned. Say these sailors are subjected to exactly the same treatment the US has been using. Would any of you be perfectly okay with that?
Well, Hicks gained weight from being well fed. So if the Iranians feed the Brits steak and kidney pie, with lots of beer, it’d be fine with me. The Brits sure wouldn’t be complaining.
/sarcasm.
Ain’t nothing like an effing idiot like “mojoo” to emphasize the moral emptiness of the left. Feh!
BTW, I wonder how many different names “mojoo” has registered under? It’s like the disposable cell phones terrorists and criminals use.
S/he waits for the “appropriate” moment to pop in like a zit with a stupid comment, insult everyone, and eventually getted banned, only to re-surface like an unwanted turd in the toilet sometime down the road.
Rude, stupid, and abusive behavior, by design. Says it all about the left these days, doesn’t it?

Shit! We can’t hang him!

- #122 – good grief shit for brains, how long since being inside another countries territorial waters was an act of war? Even if they were, which I doubt.Posted by Whale Spinor on 2007 03 27 at 01:15 AM • permalink
- Just read elsewhere one of Hick’s apologists explaining that the reason Dave is so fat is because he was (cruelly) deprived of exercise at Spa Gitmo (he should, no doubt, have been able to take pleasant evening walks to help with the digestion of all that steak and crayfish). But never mind, he’s certain to get plenty of ‘exercise’ with the ladies when he gets home if you know what I mean. But remember, no flat chested fuglys – big tits only for Mo Dawood.
- My prediction of the day. Hicks will return to Oz a convicted criminal and therefore unable to financially benefit from his crimes. His lawyer mates will try help him get around this inconvenient restriction and he will end up in the slammer guilty of fraud, or however the law characterizes the crime. I’m hoping he takes a few lawyer mates and 60 Minutes with him.

Mr Magoo beclowns his bad self, has his hat handed to him, stews on it for a good long while, then returns to compound his own buffoonery.
A fine evening’s entertainment, if you ask me.

Magoo resembles Nemesis more so than Miranda, IMHO, who still turns up on occasion with a rather pathetic snort or two. He/She addresses his/her heckling and catcalls toward Tim directly, and only rarely deigns to respond to a mere Blairite commenter.

- #122- Thanks for the gratuitous insult, usually a sign that I’ve scored a direct hit. I hope the Persians have found a way to co-erce a GPS to alter its plotting, and to alter the course of the Shatt al Arab (now is that an oxymoronic place name or what), as the boundary is placed on the low water mark on the Iranian side of that fetid waterway. Unless the poms were in a fucking hovercraft, the Iranians have kidnapped them. I’d be expecting a visit by the Regiment by the weekend if they haven’t been released, and it won’t be a clusterfuck like the Carter-era operation to the US embassy in Tehran.
I also agree with the task force commander, who has basically asked “why didn’t they just blast the fuckers the minute they came into range and showed hostile intent?”
Any attempt at escalation by the sandgoblins would have resulted in an overwhelming respose- it’s not as if there’s a shortage of weapons platforms in the near vicinity.
Now back in the sandbox as I said, little mojoo, and play nice. And if you wee your pants again, you’re going home like that and your mummy can deal with it.
Hicks is short and overweight…
Obviously he didn’t spend enough time on the rack.
Obviously he didn’t spend enough time on the rack.
Accused terrorist David Hicks has told his lawyers that conditions at Guantanamo Bay, where he has been held for five years, are “like a Nazi concentration camp”.
How many people survived five years in a Nazi concentration camp?
Remniscent of the Guildford Four…they were gaoled wrongly for years and years; they knew the IRA men and even associated daily with pro-IRA militia but did nothing. They also pleaded guilty when the English Government should’ve been crying out for mercy.
Yes, but they where like, you know …in Guildford.
- #122 This would be the same wonderful Iran that hangs teenage boys after ‘detaining’ them for months and charging them with homosexual offences?
The same Iran that hangs women for being so bold as to defend themselves from rapists?
The same Iran that has declared they are going to push Israel into the sea?
Yeah, I can see them being nice to the British sailors and marines.
Mojoo, in the words of Reginald, You Are A Fucking Moron!

- Niknarf:
The Iranians that mojoo aligns himself with will hang a girl that refuses to let herself be raped but those that do submit to the rapists are sowed into bags, buried in the dirt up to their waists and stoned to death.
mojoo is a rabid, murderous misogynist.
Islam also kills homosexuals by having them forced to kneel in front of stone or concrete walls and then the walls pushed over on them.
mojoo is a rabid and murderous homophobe.
Islam also demands that all humans bow down to allah and submit to islam or be killed.
mojoo is a rabid and murderous religous fanatic.
- So Hicks has a tan as good as Major Mori?
The evil bastards – he’s been exposed to murderous skin cancer! He’s confessed in order to avoid melanomas. Typical of the neo-imperialists to think up such a sneaky and devious form of torture as sun-tanning….
As for the long hair, I have a book by a US bomber pilot that was shot down over Italy and spent time in a German POW camp. He writes that it was common for the POWs to shave off all their hair – pubes, the lot – to avoid lice.
Clearly, Dawood has been denied the usual POW right of the right to lice.
I like that – “the right to lice”. Kind of catchy.
