JUSTICE FOR JIHAD

Muslim convert Joseph Terrence Thomas—police be upon him—has been convicted of receiving funds from al-Qaeda. Thomas (who took the name “Jihad” ) had trained with the group in Afghanistan.

The maximum penalty he faces is 25 years; I’m tipping between five and 10.

  10. I think that Australia’s mostly lost interest in this case after the media stopped calling this bloke “Jihad Jack” and everyone started wondering who Joseph Terrence Thomas was. I think that this happened less than a month after he was arrested.

    They shouldn’t feel so reluctant to call someone by their adopted name. The media would never behave this way if a porno star were arrested for something, since it’d be much too fun to refer to them by their “stage name”. Why isn’t the same standard applied to lunatic Anglo-Australian renegades with adopted Arabic names?

  20. The justice system cannot deal adequately with these cases. Evidentiary rules are weighted too heavily towards the defendant. The facts are that he was there, training, in close proximity to OBL himself, and he still gets treated like he’s just a naughty boy.
    Our legal system, along with many other HREOC-ish aspects of our society, are luxuries accorded to us in times of peace. At other times they are just a hindrance.

    If we are at war (and I think we are, because our troops are deployed in harm’s way), then, unfortunately, due process goes out the window.

    Idiots like David Hicks and old mate Jihad Jack do not deserve any legal protection from the very same societies that they *apparently* intend to destroy for the sake of Mohammedism.

    We as a society must treat these fuckers on a war footing.  There is no middle ground.

    Remember last March…the Victorian Chief Magistrate found that Jack’s mental deterioration, the severity of his detention and his cooperation with the authorities amounted to “exceptional circumstances” and should therefore allow him to be released on bail.

    That the same magistrate had turned down Jack’s first bail application so his change of mind is notable. Possibly the “vigils” held by tree huggers and apologists for for Islam made the difference. “Jack and the family are very concerned of the psychological effects of a return to detention after and independent psychiatrist found that his detention constitute what amounts to we he called secondary torture by reviving Jack’s experiences of isolation and torture in Pakistan”.

    Shit, a weekend with my ex-wife he should be spending…Oy! now that’s torture!

    As I understand it, the “War” on terror is, in fact, a “War”.

    Under the provisions of the Geneva Convention, those enemy combatants caught fighting in civilian clothes are offered no protection, and can be treated as spies.

    As such, they may be executed immediately. That is precisely why the articles of war were drafted. To prevent the enemy from using civilians as a shield.

    If the insurgents don’t use a clearly identifiable uniform, they should be shot upon capture.

The Sydney Morning Herald,today, gives Jack a very sympathetic full page and concludes that instead of a plea of “not guilty” perhaps a plea of “naive,gullible and foolish” would have been appropriate.It reveals that young Jack was raised as an Anglican but “could not reconcile the fact that the Church was founded,as he put it,by a king with venereal disease who created his own religion of convenience”.Obviously no problem with religions founded by fanciers of 9 year old “brides” though.There’s a very fetching photo of Jack in his ballet gear,I predict he will go down extremly well in Pentridge.

  50. I’m going to back away from my comment in #9 above. I’m not too sure now. The man is an fool but the prosecutors cant prove intention to commit a terrorist act. The penalty for the office (25 years) is indicative of parliamentary intention but the offence is at the extreme lower end of the spectrum (a few thousand dollars).

Another is cooporating with the enemy in time of war. He certainly did that. Moreover, there are any number of ways the Muslim blood money could have been used to undermine the State. It is a sad commentary on the prosecutors that they could not have connected the dots and gotten him on treason. The DA in Brooklyn, NY would have had him begging for the hangman’s noose.

    A MAN caught “in flagrante delicto” with a goat has been forced to marry the animal.

    Of course, the bombing of the USS Cole and 9/11 shocked him, but not enough to make him question islam.

    He’s in transit with Al Qaeda operatives, and knows they are responsible for these, and still asks if he can help them in any way. Because he doesn’t want more terror attacks like those.

  68. Some points that Robert Stary and his legal types should consider:

    Using the law as the bedrock in the fight against terrorists is dangerous to the common good.  The legal process does not prevent crime (except deterrence via punishment).  Court based legal process is a post facto blame and punishment process.
    It is almost always impossible to prove intent in advance of a crime condemning the community to a higher risk of attack.

    Terrorists consider themselves at war so we should apply a modified Geneva Convention. Terrorists fight outside the GC putting themselves beyond any law.  The GC provides for legal indefinite detention, without visitors, lawyers or consular access until the war is over. It also specifically prohibits criminal charges being laid in civil courts.  This would become defacto indefinite detention until Islam surrenders - no time soon.  The adjustment should be to medically preserve the life of a detainee in all circumstances to avoid any martyrs. 

    Let them live in relative comfort but in isolation to die of old age suffering a lifetime of psychological torment.
